Non-disclosure agreements (NDAs), often referred to as confidentiality agreements, are used frequently in the settlement of cases of workplace sexual harassment. The Respect at Work Report found that NDAs were used ubiquitously for sexual harassment and that they caused harm. The Ministerial Taskforce on Workplace Sexual Harassment recommended that they be banned in all but exceptional cases.
Gendered violence in the workplace is an occupational health and safety hazard. NDAs cause harm victim-survivors, allow employers to hide from accountability and prevent us organising collectively to eliminate workplace gendered violence.
This year, we're campaigning for legislation to end their misuse.
